Indiana Automobile Accident Law Dealing with Loss of Use and Diminished Value of Car After Crash

A common question from people who have been in a a car crash is if they can recover for the loss of use and diminished value of their car. Since I practice in both Indiana and Kentucky, I thought I would touch on the law in Indiana.

Let's say you buy a used car for $21,000.00. Since it is used, there's none of that "drive off the lot" depreciation that you get with a new car. After the car is repaired, you take it to a local dealer and they offer you $8,500.00. Why not ask the insurance company for $12,500.00 to pay for the diminished value? Even if you negotiate for less, you may still be able to get a better deal than just taking the repairs.

Of course, proof of the diminished value must support your claim. That's why you need a bona fide offer from a dealer to purchase your car as proof of the diminished value of the "use" car you purchased the day before the wreck.

I am a California attorney and doing some DV cases in California. Based upon a California case, you can only get third party claim (when someone hits you) from the other driver (or their insurance company), not from you own insurance company under an appellate court case.

I am interesting in finding a case where there would be good facts to take the issue back through the Courts as a test case to see if I can get the case law reversed in a different Califonria appellate jurisdiction and/or the California Supreme Court. Ie, a very recent model lucury car, structural damage but repairs cannot repair complete (as none can), and a loss which has not been compensated. Believe with the Allgood case from Indiana, there is a chance California courts may reconsider its position. Love to see Califonria change and follow Indiana case law on this issue. I estimate that the insuraance industry in California are cheating the insureds by as much as $3 billion per year.

Anyone interest, email me. Also, if anyone in California has tried this again and lost, I obviously want to learn about the experienc and case.
