Texting is the new way to communicate. I routinely text to family and friends. Research form Nielson indicates that people under age 45 now send and receive three times more text messages than calls on their cell phones.

We are also multi-taskers: A recent survey found that 77 percent of respondents said they've texted or sent mobile e-mail while driving; 41 percent while skiing, horseback riding, or biking; 11 percent during a romantic interlude; and 16 percent while at a funeral.

A recent study has suggested texting while driving is riskier than driving whild under the influence of alcohol or drugs. A story in the Times Online tells about research finding that motorists who use their mobile phone to sent text messages while driving dramaticlly increase the likelihood of a collision.

During the course of litigating car crash lawsuits, we are seeing more discovery request for cell phone records to determine cell phone use at the time of a crash.

The evidence is clear that it is dangerous to text while driving. I have tried to explain this to my teenage childen. I hope they are listening.

Text messaging legislation seems to be surviving in state legislatures while bans on handheld cell phones are struggling. Police continue to have concerns about having to search through cell phone records to determine if someone was texting, as you mention.
